Information on the ticket booking and sales service
Notwithstanding the above, it is hereby stated that the air transport ticket booking and sales service of Binter Canarias, S.A. which can be accessed through this website is provided by the commercial body Operaciones Turísticas Canarias Viaja S.A (OTCV), the address of which is C.C. Bulevar Local 2ª planta local 56-57, Pasaje Puerto Escondido s/n, 38003 Santa Cruz de Tenerife and with Tax Identification Code A38876454, listed in the Commercial Register of Santa de Cruz de Tenerife, Volume 2880, Folio 139, Section 8, Page TF-40611 Entry 1.
OTCV is a travel agency with Wholesale/Retail Group licence registration number IC 94, granted and supervised by the General Directorate of the Government of the Canary Islands competent in the area of tourism-related affairs.
The personal data required for the provision of this service belongs to the databases of “registered users” of Binter Canarias S.A which OTCV accesses for the sole purpose of providing said services, and the rights to access, cancel or amend must therefore be exercised before BINTER CANARIAS S.A as indicated in this legal notice.
Notwithstanding the above, in order to provide the service correctly, your personal data needs to be entered into the databases of OTCV (as the body responsible for the processing) for the sole purpose of issuing the relevant invoices and for accounting purposes. This data shall not be processed for purposes other than those described. OTCV undertakes to adopt the security measures established by article 9 of Organic Law 15/1999, on the Protection of Personal Data and Royal Decree 994/1999 approving the Regulations on security measures for computerised files containing personal data.
These measures shall be of a suitable nature in order to guarantee the security of the personal data and to prevent it from being altered, lost, processed or accessed by unauthorised persons, taking into account the status of the technology, the nature of the data stored and the risks to which it is exposed, whether caused by human action or by the physical or natural environment.
OTCV shall not store personal data on files which do not fulfil the conditions established by law with regard to its integrity and security, in processing centres, premises, systems and programmes.

General conditions for using the web site
The terms and conditions indicated below regulate access to, and use of, the web site

The expression “site" or "web site” encompasses, but is not restricted to, texts, graphs, images, videos, sounds, drawings, photographs, etc. included therein and, in general, all and any creations expressed by any tangible or intangible medium or support presently known, or which may be invented in the future, regardless of whether or not they are susceptible to intellectual property according to the Amended Text of the Intellectual Property Act, or any other law or regulation that may supersede this in the future.
Access to the site implies that the Internet user (hereinafter the user) acquires a series of rights and liabilities, in order to guarantee the appropriate enjoyment of the services and contents found therein and which BINTER CANARIAS makes available to users free of charge.
The user is aware that access to, and use of, the services and contents of the site is undertaken at his/her sole and exclusive responsibility.

BINTER CANARIAS may establish Particular Conditions for the use of certain contents and services, which will be known and accepted by the user before they are used. These particular conditions may replace, wholly or partially, complete and/or modify the contents of these General Conditions. It is understood that the user fully accepts the Particular Conditions by the mere fact of accessing or using the contents or services regulated by said Particular Conditions. Object of the web site
By accessing the web site, users may enjoy the use of different contents and services that will be offered either by BINTER CANARIAS or by third party suppliers in the conditions determined for them.
In general, the services and contents offered on the site will be available in Spanish, English and German, notwithstanding the possibility, at the discretion of BINTER CANARIAS, of providing access to these in the remaining official regional languages of Spain, as well as in other languages of the European Union, other than those mentioned above.
BINTER CANARIAS reserves the right to maintain, exclude or modify the contents and services provided on the web site, without prior notice to users, notwithstanding the contents of the Particular Conditions that may regulate the use of a given service and/or contents intended for clients of BINTER CANARIAS.

The cost of the use of the telephone or any other kind of expenses involved in connecting to gain access to the web site will be met entirely by the user. The user only has to meet the necessary technical conditions to benefit from the use of the site.

Use and custody of access codes
Whatever access codes – user name and password – that, where applicable, BINTER CANARIAS may make available to web site users and/or clients of BINTER CANARIAS for accessing and/or using a given service or content of the web site, are confidential, secret, personal and not transferable for accessing and/or enjoying the aforesaid service or contents.
Any service or contents that require user validation with access codes for their access or enjoyment may be blocked by BINTER CANARIAS if 5 successive errors are made in entering the code. Nevertheless, BINTER CANARIAS may vary this number of errors after first informing users of the change. The block will only be lifted once BINTER CANARIAS has satisfactorily checked the identity of the user. Having lifted the block, new codes will be issued and delivered.
Users are responsible for the confidentiality of their access codes and these should never be given to third parties under any circumstances, nor should users facilitate their discovery by recording them on any kind of support.
Should access codes become known, either by chance or fraudulently, to unauthorised third parties, or should any other kind of incident that could in any way compromise the confidentiality of said codes occur, BINTER CANARIAS will be informed immediately by telephone, conventional mail or by electronic mail.

Intellectual and industrial property

BINTER CANARIAS informs users that the exercise of the aforementioned rights is strictly personal and the user is the only person who can exercise those rights in connection with the personal data of which he/she is the legitimate owner. Security measures
BINTER CANARIAS guarantees to adopt the security measures established in article 9 of the Personal Data Protection Act (Organic Law 15/1999) and Royal Decree 994/1999, adopting the regulations on security measures for automated filing systems that contain personal data.
These measures will be the appropriate ones to guarantee the security of personal data and avoid their alteration, loss, processing or unauthorised access, having regard for the development of technology, the nature of the data stored and the risks they are exposed to, either from human action or from the physical or natural environment.
BINTER CANARIAS will not record personal data in filing systems that do not meet the requirements established by the regulations with regard to their integrity and security, nor will it store them in processing centres, premises, equipment, systems or programmes.
Should third party companies have access to the personal data of users for the purpose of providing a service to BINTER CANARIAS, BINTER CANARIAS guarantees users that the service provision contracts signed with those companies will stipulate the security measures that they are obliged to adopt by virtue of the nature of the data they access to and in accordance with the LOPD and Royal Decree 994/1999.
Recommendations on the use of the Internet
BINTER CANARIAS reminds users that the Internet is not always as safe as we might wish it to be. Thus, appropriate and necessary technical measures should be adopted in order to prevent the unauthorised processing of their data.
Whenever the user provides personal information over the Internet, by electronic mail, to news groups, discussion groups, etc., the user should not forget that this information can be collected and processed for purposes the user does not want.
